1. Acceptance of Terms

By accessing and using the Metal IQ website or engaging with our metal fabrication services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

Metal IQ provides custom metal fabrication services, including but not limited to:

• Metal roofing and siding systems
• Metal flashing and trim components
• Custom sheet metal fabrication
• Architectural metal components and custom chimney caps

All fabrication work is performed to customer specifications and project requirements.

3. Quotes and Orders

All quotes provided by Metal IQ are estimates based on the information provided at the time of request. Final pricing may vary based on actual project specifications, material costs, and complexity. Quotes are valid for the period specified in the quote document.

Orders are considered confirmed upon receipt of a signed purchase order or written acceptance of our quote. Changes to confirmed orders may result in additional charges or revised delivery timelines.

4. Pricing and Payment

Prices are subject to change without notice until an order is confirmed. Payment terms will be specified in your order confirmation. We reserve the right to require deposits or full payment before commencing fabrication work.

Late payments may incur interest charges and may result in suspension of services or delayed delivery.

5. Delivery and Shipping

Delivery dates are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to material shortages, weather, transportation issues, or acts of God.

Risk of loss and title to products pass to the customer upon delivery to the carrier or customer's designated location. Customers are responsible for inspecting shipments upon receipt and reporting any damage or discrepancies within 48 hours.

6. Quality and Warranties

Metal IQ warrants that our fabrication work will conform to the specifications agreed upon in the order. We perform quality inspections for dimensional accuracy and finish consistency.

This warranty does not cover damage resulting from improper installation, misuse, normal wear and tear, or modifications made after delivery. Warranty claims must be submitted in writing within 30 days of delivery.

7. Specifications and Drawings

Customers are responsible for providing accurate specifications, drawings, and project requirements. Metal IQ will fabricate according to provided specifications. We are not responsible for errors or omissions in customer-provided documentation.

Any changes to specifications after order confirmation may result in additional charges and revised timelines.

8. Intellectual Property

All designs, drawings, and technical information provided by Metal IQ remain our intellectual property unless otherwise agreed in writing. Customer-provided designs and specifications remain the customer's property.

9. Limitation of Liability

To the maximum extent permitted by law, Metal IQ's liability for any claims arising from our services is limited to the value of the specific order in question. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

Customers agree to indemnify and hold Metal IQ harmless from any claims, damages, or expenses arising from the customer's use of our products, including but not limited to installation issues or non-compliance with building codes.

11. Cancellation and Returns

Custom fabricated products are non-returnable. Cancellations of confirmed orders may be subject to cancellation fees based on work completed and materials ordered. Cancellation requests must be submitted in writing.

12. Force Majeure

Metal IQ is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, labor disputes, material shortages, or government actions.

13. Governing Law

These Terms of Service are governed by the laws of the State of Oregon, United States. Any disputes will be resolved in the courts of Oregon.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
